your challenges

Your duty to manage asbestos

In recent years we have seen a rise in HSE prosecutions of landlords, and also claims from residents, from failure to identify asbestos in construction works. Failure to address asbestos issues can result in prosecution, compensation pay-outs, reputation damage and construction cost rectification.

To protect yourself you need to ensure that your organisation complies with current UK regulations.

The Control of Asbestos Regulation (CAR) 2012 places a Duty to Manage on the Duty Holder (person or organisation that has clear responsibility for the maintenance or repair of a building):

To identify whether the buildings under their control contain asbestos
To keep records of the location of the asbestos and the condition of the building
To prepare, review and monitor a plan to manage the risk from asbestos

About Asbestos

Why is asbestos a problem?

Large amounts of asbestos were used in new and refurbished buildings before 2000. Much of this asbestos is hidden in the fabric of the building so not immediately obvious – it is also unlikely to be recorded in the building plans. When asbestos materials are damaged or disturbed they can release dangerous fibres which, if breathed in, can cause serious diseases.

Who are UKATA?

UKATA (the United Kingdom Asbestos Training Association) is a leading association dedicated to improving the quality and standards of asbestos training, with the ultimate goal of protecting workers and the public from the risks associated with asbestos exposure.

What UK regulations do I need to be aware of?

The Control of Asbestos Regulation (CAR) 2012 is the key piece of regulation covering asbestos compliance in the UK.

Who in my organisation needs asbestos awareness training?

Any workers that either specifically work with asbestos, or who are liable to be exposed to asbestos as part of their job, are required to have been given adequate information, instruction and training. This should be appropriate to the work or role being undertaken.
